Terms of Use

These Terms of Use ("Terms") govern your use of the He & Me mobile application and related services (the "Platform" or "Services"), made available by [OPERATOR_NAME] ("He & Me", "Company", "we", "us", "our"), operating under the laws of India with its registered address at [REGISTERED_ADDRESS]. He & Me is a dating and social app for LGBTQ+ adults. These Terms are to be read with the He & Me Privacy Policy and the Safety & Child Protection Policy. Our Services and these Terms are in accordance with the Information Technology Act, 2000 and other applicable Indian laws, including all rules framed thereunder.

By creating an account or using the Platform, you accept and agree to these Terms. If you do not agree, do not use the Platform. We do not represent that the Platform complies with the laws of any jurisdiction other than India; if you use it from outside India, you are responsible for complying with your local laws.

1. Changes to the Terms and Services

The Platform is dynamic and may change. We may add, modify, suspend, or discontinue Services or features at our discretion, and we may update these Terms as the service evolves. Where your consent is legally required for a change, we will ask for it. Continued use after changes means you accept the updated Terms.

2. Eligibility

• You must be at least 18 years old. By using the Services you represent and warrant that you are 18 or older.
• You are legally capable of entering into a binding agreement under Indian law.
• You are legally permitted to use the Services under the laws of India and of your place of residence.
• You will use the Services only for lawful purposes and in accordance with these Terms.

We may ask you to verify your age or identity and may restrict or terminate accounts that provide false information or fail verification when requested.

3. Your account

You register with your mobile number (verified by OTP) or your Google account, and you confirm you are 18+. You must provide accurate, authentic information that is lawfully yours to use, and you must not impersonate anyone or use another person's details. One account per person. You are responsible for keeping your device, credentials, and account secure, and for all activity on your account. Do not share your account or create multiple accounts without our permission.

4. The Service

He & Me provides a digital space for adults to discover and communicate with other adults. We do not guarantee matches, compatibility, or relationship outcomes. You are solely responsible for your interactions with other users, including any communications, transactions, or meetings that occur on or off the Platform.

5. Intermediary status

He & Me operates as an intermediary under the Information Technology Act, 2000 and the rules made thereunder. We do not create, author, endorse, or control user-generated content, and we do not verify the identity, character, or intentions of any user beyond the limited steps stated in these Terms. We reserve the right to remove content or restrict access where required to comply with law, enforce these Terms, or protect users or the Platform.

6. Acceptable use — you must not:

• Harass, threaten, stalk, abuse, or repeatedly contact a user who has asked you to stop; or use hate speech or discriminatory content based on caste, religion, gender, sexual orientation, or any protected category.
• Impersonate any person, create fake profiles, or provide false or misleading information.
• Share, request, or threaten to share private, confidential, or intimate information without consent; or engage in blackmail, extortion, fraud, phishing, or deception.
• Upload or share content that is obscene, pornographic, harmful to minors, unlawful, discriminatory, violent, hateful, or otherwise prohibited under Indian law.
• Share or request non-consensual sexual content, any content involving minors (see §8), or use the Platform for prostitution, escort services, or trafficking.
• Use the Platform for spam, advertising, solicitation, or any commercial purpose without our permission.
• Record conversations, take screenshots, or distribute content to harass, expose, or misuse any person without consent.
• Interfere with the security, integrity, or functioning of the Platform — including unauthorised access, bots, scraping, or malicious software.

7. Reporting, moderation & enforcement

We may use automated tools and user reports to detect misuse, maintain safety, prevent fraud, and enforce these Terms. Users may report profiles or messages in-app (Report / Block) or by contacting support. We may — but are not obliged to pre-screen — monitor activity, remove content, restrict features, suspend, or permanently ban accounts that violate these Terms or create risk. Repeated or serious violations may result in permanent termination and a block on re-registration. We may share information with law enforcement where required by law or to protect users or the public.

8. No minor content (zero tolerance)

He & Me is for people 18 or older. Any upload, sharing, solicitation, storage, transmission, or use of content involving a person under 18 in a sexual, obscene, exploitative, abusive, or inappropriate manner — including morphed, fabricated, or AI-generated depictions — is strictly prohibited, will lead to immediate account termination, and will be reported to the competent authorities. 9. Your content & intellectual property

You retain ownership of the content you upload (photos, text, messages). By sharing content, you grant He & Me a limited, non-exclusive licence to store, display, and process it only as needed to provide, improve, and protect the Services. This licence continues until you delete the content or your account, except where retention is required by law or for legitimate safety, legal, or operational purposes. You must not upload content that infringes anyone's intellectual property, privacy, or other rights. All rights in the Platform itself (software, design, name, logo, trademarks) remain the property of the Company or its licensors and may not be copied or reused without permission.

10. No endorsement; conduct of users

We do not endorse, control, or take responsibility for content shared by users, or for the conduct of any user, whether their interactions occur on or outside the Platform. The presence of our name or logo does not mean we approve any user or their content.

11. Safety

He & Me does not run background or identity checks on users and makes no representation about any user's identity, character, or intentions. Please: do not share financial details, do not send money to other users, meet in public places first, and tell someone you trust before any offline meeting. You use the Services and meet other users at your own risk.

12. Third-party services

The Platform may use third-party services (e.g. payments, analytics, sign-in, calling). Their own terms and privacy policies apply, and we are not responsible for third-party services. Please review them separately.

13. Communications

By using He & Me you consent to receive communications from us — account and security messages, OTPs, service updates, and (where permitted) promotional messages — via in-app notifications, push, email, or SMS. You may opt out of promotional messages at any time (via the unsubscribe option or by contacting support); essential service messages will still be sent.

14. Subscriptions & payments

He & Me is currently free. If we introduce paid plans, prices will be shown before purchase, renewals and cancellation terms will be disclosed at that time, and — except where required by law — payments are non-refundable. We will update these Terms before charging any fee.

15. Term, termination & survival

These Terms apply from when you first use the Platform until terminated. You may delete your account any time from Settings → Account. We may suspend or terminate your account, restrict access, or remove content at any time, with or without notice, if we believe you have violated these Terms or applicable law, or if your use creates risk. On termination your right to use the Platform ceases. Provisions that by their nature should survive — including §§ 9, 10, 16, 17, and 18 — continue after termination.

16. Disclaimers

The Platform and Services are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or secure, and we are not responsible for the conduct of any user, on or off the Platform. You use the Services at your own risk.

17. Limitation of liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, data, revenue, goodwill, or emotional distress, arising from your use of the Platform, removal of content, suspension of accounts, or the conduct of other users. Our total aggregate liability shall not exceed the amount you paid to us (if any) in the one (1) month preceding the claim.

18. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its affiliates, officers, directors, and employees from any claim, loss, damage, liability, cost, or expense (including reasonable legal fees) arising out of: (i) your use of the Platform; (ii) your breach of these Terms; (iii) your violation of any third party's rights, including intellectual-property or privacy rights; (iv) your violation of any law; or (v) your negligence or wilful misconduct. This obligation survives termination.

19. Governing law & jurisdiction

These Terms are governed by the laws of the Republic of India. The courts of Bengaluru, Karnataka shall have exclusive jurisdiction over all disputes.

20. Grievance Officer

In accordance with the Information Technology Act, 2000 and the rules thereunder, our Grievance Officer addresses concerns regarding content, safety, privacy, and platform usage:

We will acknowledge complaints within 24 hours and endeavour to resolve them within 15 days, as prescribed under applicable law. Content flagged as unlawful will be acted on within 36 hours of actual knowledge.

21. General

• Severability: if any provision is unenforceable, the rest remain in effect.
• Waiver: our failure to enforce a provision is not a waiver of it.
• Amendment: any waiver or amendment by us must be in writing.
• Force majeure: we are not liable for delays or failures beyond our reasonable control (acts of God, war, civil disturbance, utility or network failures, government action, or failure of third-party providers).
• Feedback: any feedback or suggestions you give us may be used without restriction or obligation to compensate you.
• Reservation: we reserve all rights not expressly granted.
